These Terms of Service ("Terms") govern your use of Agent Copilot, a web application operated by Kaiflux ("Kaiflux," "we," "us") at app.kaiflux.io (the "Service"). By creating an account or using the Service, you agree to these Terms.
Agent Copilot is an AI writing assistant for licensed real estate professionals. It generates listing descriptions, social media posts, lead follow-up messages, objection-handling scripts, and client communications based on details you provide, and includes a lead-notification dashboard ("Leads") that surfaces conversations from Kaiflux's First Responder product where applicable to your account.
You must be at least 18 years old and use the Service for legitimate real estate business purposes. You are responsible for the accuracy of the information on your account and for all activity under it. You must sign in using our authentication provider (Clerk); do not share your account credentials.
New accounts start on the Free plan, limited to 14 days from account creation or 30 total generations, whichever comes first. Once either limit is reached, you must subscribe to a paid plan to continue generating content.
Paid plans (Starter, Pro, Unlimited) are billed monthly in advance via Stripe, in US dollars, and renew automatically until cancelled. You can cancel anytime; your plan remains active through the end of the billing period you already paid for. We do not store your card details, Stripe processes and stores all payment information directly. Except where required by law, payments are non-refundable once a billing period has started.
Content generated by the Service is produced by an AI model (Anthropic's Claude) and is a drafting aid, not a substitute for your own professional judgment. The Service applies automated checks intended to reduce Fair Housing Act violations and fabricated facts, but these checks are not a guarantee of legal compliance or factual accuracy. Before publishing or sending any generated content, you are solely responsible for reviewing it against your MLS data, your brokerage's compliance policies, Fair Housing law, and any other applicable regulation in your jurisdiction. Kaiflux is not liable for content you choose to publish without review.
You own the content you generate using the Service. Kaiflux owns the Service itself, including its prompts, guardrail logic, software, and branding. You grant us a limited license to process the details you submit solely to generate your requested content and operate the Service.
The Service relies on third-party providers to operate: Clerk (authentication), Stripe (billing), Anthropic (AI generation), Cloudflare (hosting and data storage), and Twilio/Make.com (lead SMS and automation, for accounts using First Responder). Your use of the Service is also subject to the availability and terms of these providers.
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Kaiflux is not liable for indirect, incidental, or consequential damages, including lost business, lost profits, or Fair Housing or other regulatory complaints arising from content you chose to publish without independent review. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months preceding the claim.
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate accounts that violate these Terms, including misuse of the Leads dashboard or attempts to circumvent usage limits.
We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms. Material changes will be reflected by an updated effective date above.
These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles, unless a mandatory law of your own country of residence requires otherwise.
